Please read the following terms and conditions carefully. These terms and conditions apply to your booking with PE Retreats ACN# 677 242 214 (PE Retreats, we us). By making your booking you are irrevocably agreeing to enter into a contract with us on these terms and conditions. That contract becomes binding immediately on our confirmation of your booking.

DEFINITIONS

“Cancellation” is defined as not attending your scheduled retreat, including postponing or rescheduling. “You” refers to the guest booking a retreat. “We” refers to PE Retreats. It is your responsibility to read and understand our cancellation policy before making a reservation. 

PRICES

All advertised retreat prices are subject to availability and can be withdrawn or varied by us for any reason without notice prior to booking and payment of deposit. Prices are quoted in Australian dollars and inclusive of GST. 

We may increase the price of your booking at any time before your booking is paid in full to reflect any changes in our costs related to your booking which are beyond our reasonable control, which may include (without limitation) exchange rates fluctuations, changes in the price of fuel, the level of taxes or fees imposed by third parties including tourist taxes, landing taxes or embarkation/disembarkation fees at ports and airports.

PAYMENT POLICY

To reserve a spot on a specified retreat, a non-refundable booking fee of $500 is required upon booking. Payment of the deposit means you have accepted our terms and conditions. We will notify you when your booking is confirmed. Full payment (the balance) must be made within 60 days of the retreat start date. In some circumstances we may offer payment plan alternatives. If we do, and you select that payment alternative, then you must make each payment by the due dates indicated (This is generally 14 days from the issued invoice). 

Where full payment or any part thereof is not made by the invoice due date, we may treat your booking as being cancelled by you. In that instance we will retain any applicable cancellation fees and refund the balance of your payment as a credit note to you.

Prices are based per person, shared (share with another retreat guest or bring a friend/partner) or for private rooms where specified, but DO NOT include flights. Clients must have adequate travel insurance to cover all activities listed.

TRAVEL INSURANCE

For all international retreats, you must obtain travel insurance covering all dates and destinations of travel. Your insurance must cover at least: trip interruption, personal injury, medical expenses, evacuation and repatriation cover including during pandemic events. 

All PE Retreat guests should be well acquainted with government travel warnings and advice to retreat destinations before attending a retreat. Although we strongly encourage you to do so, you acknowledge that PE Retreats is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially or otherwise.

Naturally, no one books with the intention of cancelling or postponing their retreat, but unexpected things do happen, so please consider purchasing travel cancellation insurance.

HEALTH AND SAFETY

You must also declare any health, medical or dietary issues and requirements to us at the time of your booking and where necessary update that information prior to departure and during the retreat. Based on these disclosures we may require you to provide a medical certificate confirming that it is safe for you to participate in a retreat. Despite these disclosures and any medical certificates provided, you are wholly responsible for your own health, safety and wellbeing at all times during the retreat, including during all activities. You are free to stop or decline participating in any activity at any time for any reason.

You must also ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. You should consult your doctor regarding health requirements for your destination and your suitability to participate in the activities provided.

PASSPORTS AND VISAS

It is the responsibility of each participant to obtain a valid passport, visa(s) and necessary certificates for any country to be visited in connection with a retreat. Many countries require at least 6 months passport validity from the date of entry. You release and indemnify PE Retreats from all responsibility and liability for any refusal of entry, detainment, or other action. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities are your sole responsibility. Please note that there will be no refund/credit given to a retreat guest due to issues involving passports/visas.

GUEST CANCELLATION POLICY

PE Retreats will provide a full refund if you cancel within 24 hours of booking and that booking was made more than 70 days before the scheduled retreat date. We do not otherwise provide cash refunds unless required by law.

Should you choose to pay via the payment plan option, however request cancellation before all payments have been made, you will still be required to pay the full amount of the package.

Subject to law and the 24-hour refund clause above, if you cancel your booking, or fail or are unable to attend a booked retreat, we will retain the following cancellation fees:

• If you cancel more than 70 days before your retreat start date, you will be refunded the full retreat amount less any bank or exchange fees and your deposit*
• If you cancel 70 days or less before your retreat start date, you will forfeit your entire payment*

* If the retreat is cancelled due to causes over which PE Retreats has no control, including quarantine, pandemic, hurricanes, other acts of god etc. PE Retreats will be relieved from any obligation to perform under this contract and may refund your payment insofar as possible, taking into consideration any costs paid by PE Retreats that cannot be recovered by us.

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.

We do not offer credit for arriving late or leaving early. A guest can change to another retreat 60 days or before your retreat start date for a fee of $250.  Please note the retreat must have availability.

PE RETREATS CANCELLATION POLICY

While we don’t intend to ever cancel a retreat, if PE Retreat’s must cancel for any reason you’re entitled to transfer your full retreat payment to another retreat (either scheduled or at some future time). Alternatively you may request a refund of your applicable payment, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your retreat. Refunds can take up to 120 days to enter your account.

If the retreat is cancelled due to causes over which PE Retreats has no control, including quarantine, pandemic, hurricanes, other acts of god etc. PE Retreats will be relieved from any obligation to perform under this contract and may refund your payment insofar as possible, taking into consideration any costs paid by PE Retreats that cannot be recovered by us.

PE Retreats is not responsible for your expenses incurred in preparation for any cancelled retreat such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

If an event needs to be postponed due to circumstances out of our control you will be provided with your choice of a place on the new event date or a 100% credit voucher to use on any of our retreats.

CREDIT NOTES

All credit notes issued by PE Retreats pursuant to these terms and conditions or otherwise are valid for use for 12 months from the date of issue. You are not entitled to a refund or any other remedy for any unused portion of an expired credit note. In our sole discretion we may extend the validity of credit notes for a longer period if we consider we have not provided a reasonable opportunity for the holder to use the credit note.

Credit notes are not redeemable for cash or refund.

THIRD PARTIES

PE Retreats holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a retreat as compared with the advertised nature of the service.

GENERAL WAIVER

You acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat organisers, and insofar as legally permissible, surrender your right to any cause of action against PE Retreats arising from any loss or damage to person or property that occurs during a retreat.

PRIVACY

By booking with us you acknowledge that we will collect, use and disclose your personal information (including to our third party service providers) as we reasonably require to provide the service to you, and for other reasons permitted under privacy laws (including direct marketing).

PHOTO/VIDEO RELEASE FORM

You hereby grant to PE Retreats the absolute and irrevocable right and unrestricted permission to use photographic portraits / images / videos in which You feature that are taken during the course of the retreat to use / republish / copyright, etc. for commercial use in association with PE Retreat’s business. You hereby release and discharge PE Retreats from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

LIABILITY 

As a retreat guest, you indemnify, hold harmless and forever discharge PE Retreats, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers and trustees of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that You ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by PE Retreats, provided that this waive of liability does not apply to any acts of gross negligence, or intentional, wilful or wanton misconduct.

You understand that the activities, in which You will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of Yourself, your heirs, assigns, administrators, executors and next of kin, You waive all claims of damage, injuries and death sustained to You or Your property, that I may have against the aforementioned release party to such activities, including claims in tort, contract, equity or otherwise.

You acknowledge, agree and represent that You understand the nature of PE Retreat’s business, You are IN GOOD HEALTH and in PROPER PHYSICAL CONDITION to participate in such activities. You further agree and warrant that if at any time You believe conditions to be unsafe, You will IMMEDIATELY DISCONTINUE further participation in the activity.

By this Waiver, You assume any risk, and take full responsibility and waive and of personal injury; death, damage, or loss of personal property, associated with PE Club, including but not limited to using the facility and its equipment in any manner, form or fashion, and participating and/or engaging in any, event or other related activities on and off the premises.

This WAIVER AND RELEASE contain the entire agreement between parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.

The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of PE Club, whether by agreement, by operation of law, or otherwise.

You have read, understood and fully agree to the terms of this WAIVER AND RELEASE. You understand and confirm that by signing this WAIVER AND RELEASE You have given up considerable future legal rights.

If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.  

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you-

• are rendered with due care and skill; and
• are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
• might reasonably be expected to achieve any result you have made known to the supplier.

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

COVID 19 POLICY

The wellbeing of our guests is, and always has been, our highest priority. In light of the COVID-19 outbreak around the world, we have implemented a number of precautionary measures to ensure the health and safety of our guests and team.

If the retreat is cancelled due to a covid 19 outbreak, quarantine, pandemic, border closures etc, PE Retreats will be relieved from any obligation to perform under this contract and may refund your payment insofar as possible, taking into consideration any costs paid by PE Retreats that cannot be recovered by us.

We continue to monitor the situation closely and review our retreats on the advice of the World Health Organisation, Centre for Disease Control and other departments from around the world. If there are any changes to your retreat, you’ll be contacted directly to discuss your options.

Guests may be asked to get a test within 72 hours from their retreat and produce a negative result before attending.
